What Does an Adoption Defense Attorney Do?
![]() |
Hopefully you will never need an adoption defense attorney. However, it is good to have one in mind if anything unfortunate does arise. A defense attorney is used to defend you in a court of law. If you are sued or accused of a crime, this is the type of attorney you need. Let's say you have adopted a child but the birth mother is trying to take the child from you. One of these defense attorneys are what you need to defend yourself and protect your best interest. Often your adoption attorney can serve as a defense attorney as well.
An adoption attorney helps you through the adoption process. For example, an adoption attorney will review all applications, documents and contracts before they are filed to ensure all paperwork is legitimate and appropriate. They will protect you against overly high fees and make sure the agency you are dealing with operates as it should. If you are doing a private adoption, the attorney handles all the legalities of the adoption and works to protect your parental rights. While the birth mother can change her mind before the baby is born, you want the attorney to make sure she is unable to do so after the child has been given to you.
This type of legal professional may also handle international adoptions. Most international adoptions must also go through an agency who is accredited in handling adoptions from the country you've chosen. Your attorney can help you with the international paperwork and may even accompany you to the country to handle the paperwork there. For some countries you will need to spend days, even weeks, in the country. Sometimes you will have to visit more than once.
You might think an adoption defense attorney is too expensive to retain. While it's true that all attorneys are costly, it is nowhere near as costly than going without one. You simply cannot adopt without good legal representation, so it's fruitless to try. What you can do is comparison shop and try to find an attorney who offers the services you need at a price you can afford. Different attorneys charge different rates, so shop around and compare prices before making your final choice.
